1. Acceptance
These terms are an agreement with Geniusko OÜ, registry code 17603636, Pärnu mnt 186, Tallinn, 11314, Estonia. By using the software, you agree to these terms. If you do not agree, do not use it.
2. The software
Geniusko is software that a business uses to audit, manage, and prepare advertising on Meta platforms, and to generate content for that advertising. With the business's consent, the software connects to the Meta advertising account the business authorizes, reads performance, and applies changes such as pausing an ad only when the business directs it to.
With consent, the business can also connect its own Google Ads account, a Google Analytics property, Search Console, YouTube, TikTok, or its own Etsy shop. Geniusko reads only the data described in the privacy policy. For Google Ads, a campaign changes only after the business confirms. We do not become the manager account.
3. Connected accounts
You may connect only accounts you are allowed to manage. You follow the terms of Meta, Google, YouTube, TikTok, and Etsy when you use those connections. You can disconnect each one in the software.
When you connect a Meta account, you agree to the Meta Platform Terms and Developer Policies, and you will not use data obtained through Geniusko in a way that would violate them. Geniusko OÜprocesses that data as a Tech Provider, only for your purpose and at your direction. We may end your Meta connection through Geniusko if Meta asks us to because it believes you have violated its terms or are harming its platform or its users. If Meta sends us a communication about a person's request concerning their data, we will pass it on to you promptly.
By connecting YouTube you agree to the YouTube Terms of Service. The video you upload remains yours. We do not change channel settings or other people's videos.
Geniusko OÜis the application developer for an Etsy connection. The software reads the shop the business owns so it can show that shop's own aggregated results. We do not scrape Etsy and we do not use the Etsy API to research other sellers or to train models on Etsy catalog content.
This application is solely provided by Geniusko OÜ(the "application developer"). Etsy, Inc. and its affiliates are not the application developer, do not provide the application, and make no warranties about the application or data accessed through it. The term "Etsy" is a trademark of Etsy, Inc. This application uses the Etsy API but is not endorsed or certified by Etsy, Inc.
4. Accounts
You are responsible for the activity under your account and for keeping the login confidential. Tell us if you believe someone else is using it.
5. Your content
You keep ownership of content you create or upload. You give Geniusko OÜa non-exclusive license to use that content only to provide the software. You will not submit content that is illegal or that infringes someone else's rights. We may remove content that breaks these terms.
6. Our software
Geniusko OÜ and its licensors own the software, designs, and documentation. These terms do not transfer that ownership. You review content before you publish it. We do not promise a particular advertising result, uninterrupted operation, or that AI output will be correct.
7. Ending access
We may suspend or end access if you materially break these terms, or if we must do so for security or to comply with the law. Where we can, we tell you first. You may stop using the software at any time and ask us to delete your data as described in the privacy policy.
8. Liability
If you use the software for a business, then to the extent the law allows we are not liable for lost profits, lost revenue, or indirect damage. Nothing in these terms limits liability that the law does not allow us to limit.
9. Data protection
When a business uses Meta Pixel or the Conversions API through Geniusko, it may send personal data of its visitors to Meta. For that data the business is the controller and Geniusko OÜ is the processor. The business is responsible for a lawful basis and for the notices and consents its visitors require. We delete that data when asked, as described on the data deletion page.
10. Law and changes
These terms are governed by the laws of the Republic of Estonia.
We may change these terms. If a change is material, we post the new terms on this page before they take effect. If you do not accept them, stop using the software.
